These Terms of Service are governed by the laws of the State of California, USA, where Metro Recycling operates from its facility in Calexico, California.

Agreement

By using any service, purchasing materials, selling catalytic converters, or engaging in any communication with Metro Recycling ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use our services or engage in business with us.

These terms constitute a legally binding agreement between you and Metro Recycling in accordance with California Business and Professions Code and applicable federal regulations governing recycling and precious metal recovery operations.

Age Requirement: You must be at least 18 years old to conduct business with Metro Recycling, as required by California law.

Services Provided

Metro Recycling provides the following services:

Catalyst Recycling Services

  • Purchase and processing of catalytic converters (automotive and industrial)
  • Processing of DPF (Diesel Particulate Filters) and DOC (Diesel Oxidation Catalysts)
  • Recycling of petrochemical catalysts
  • XRF analysis for precious metal content determination
  • Lot management and tracking services

Analysis & Valuation

  • Laboratory analysis using XRF technology
  • PPM (parts per million) content reporting for Platinum, Palladium, and Rhodium
  • Market-based pricing calculations
  • Detailed lot valuation reports

California Compliance: All services comply with California Environmental Protection Agency (CalEPA) regulations, California Department of Toxic Substances Control (DTSC) requirements, and local air quality management district rules.

Communication Terms

By submitting your contact information, you consent to receive business communications via:

  • SMS/Text Messages: Transaction confirmations, lot status updates, and payment notifications
  • Email: Invoices, analysis reports, market updates, and business correspondence
  • Phone Calls: Customer service, urgent matters, and business inquiries
  • WhatsApp: International communications and quick updates

Prohibited Conduct

The following activities are strictly prohibited and may result in immediate termination of services and legal action:

Illegal Activities

Attempting to sell stolen catalytic converters or materials obtained illegally. We comply with California Penal Code Section 484 and cooperate fully with law enforcement.

Fraud & Misrepresentation

Providing false information, misrepresenting material origins, tampering with materials, or attempting to defraud our analysis systems.

System Abuse

Spamming, harassment, abuse of our communication tools, attempting to hack our systems, or any unlawful use of our warehouse management platform.

Documentation Violations

Failure to provide required documentation under California Business and Professions Code Section 21608.5, including proper identification and material ownership verification.

Third-Party Services

We may use third-party tools and services to operate our business efficiently:

Service Providers

  • Communication Platforms: SMS services, email providers, WhatsApp Business
  • Shipping Partners: DHL, FedEx, UPS, and regional carriers
  • Payment Processors: Banks and wire transfer services compliant with US financial regulations
  • Laboratory Services: Certified XRF analysis providers
  • Cloud Services: Secure data storage and backup systems

Use of these third-party services is subject to their respective terms and privacy policies. We ensure all third-party providers comply with California data protection laws and industry standards.

Liability

Limitation of Liability

Services are provided "AS IS" in accordance with California Commercial Code

Disclaimers:

  • Metro Recycling is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services
  • Our liability shall not exceed the amount paid for the specific transaction in dispute
  • We are not responsible for market price fluctuations of precious metals
  • Analysis results are based on sample testing and may vary

Indemnification:

You agree to indemnify and hold Metro Recycling harmless from any claims, losses, or damages arising from your violation of these terms, applicable laws, or third-party rights.

California Law: Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some of the above limitations may not apply.

Termination

We reserve the right to suspend or terminate access to our services:

Immediate Termination

For violations of these terms, illegal activities, or fraud attempts

30-Day Notice

For operational changes or business decisions with proper notice

Legal Requirements

When required by law enforcement or regulatory agencies

Your Right to Terminate

You may stop using our services at any time

Upon termination, any pending transactions will be completed according to the original terms, and final payments will be processed within 30 business days.

Changes to Terms

We may update these Terms of Service at any time to reflect changes in our services, legal requirements, or business operations. When we make changes:

  • The updated terms will be posted on our website with a new effective date
  • Material changes will be communicated via email to active customers
  • Continued use of our services after changes constitutes acceptance of updated terms
  • You may request a copy of previous versions for your records

California Notice Requirement: We will provide at least 30 days notice for any material changes that may affect your rights or obligations.

Legal Agreement
